Brazil Halts Meta's Data Processing Over New AI Privacy Policy
The Brazilian National Data Protection Authority (ANPD) has announced the immediate suspension of Meta's latest privacy policy which pertains to the use of personal data in training generative artificial intelligence (AI) systems. This decisive action was made public in Brazil's official gazette on Tuesday, halting all personal data processing activities across Meta's suite of products, including data from individuals who are not active users of the company's platforms.
Preventive Measure and Penalties
The ANPD, operating under the umbrella of Brazil's Justice Ministry, issued this preventive measure citing concerns over potential "serious and irreparable or difficult-to-repair damage to the fundamental rights of affected holders." The agency has imposed a daily fine of 50,000 reais (approximately $8,836.58) for non-compliance.
Required Adjustments from Meta
In response to this order, Meta must revise its privacy policy to remove provisions related to the processing of personal data for generative AI training. Additionally, Meta is obligated to provide an official statement confirming the cessation of this data processing activity.
Meta's Reaction
Meta has expressed disappointment with the ANPD's decision, characterizing it as a hindrance to innovation that will delay the benefits of AI advancements for Brazilian citizens. The company defended its practices, stating, "We are more transparent than many players in this industry who have used public content to train their models and products. Our approach complies with privacy laws and regulations in Brazil."
