Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Wobidobi website, applications, software, and related services (collectively, the “Service”). The Service is provided and operated by Wobidobi LLP, a limited liability partnership registered in the Republic of Kazakhstan (“Wobidobi,” “we,” “us,” or “our”).

By creating an account, accessing the Service, or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you do not agree to these Terms, do not access or use the Service.

1. Eligibility and authority

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. If the law where you live requires a higher minimum age, that higher age applies. You may not use the Service if applicable law prohibits you from receiving it or if we have previously suspended or terminated your access for a material violation of these Terms.

2. The Service

Wobidobi provides software tools for creating, publishing, managing, and analyzing forms, surveys, response workflows, workspaces, templates, and related digital content. Features, usage limits, storage, support levels, and other entitlements depend on the plan shown when you subscribe. We may improve, modify, add, or remove features from time to time. We will not materially reduce the core functionality of a paid plan during its current paid term without reasonable notice, except where a change is necessary for security, legal compliance, or to prevent abuse.

3. Accounts and workspace administration

You must provide accurate, current, and complete account information and keep it up to date. You are responsible for safeguarding your password and authentication credentials, for the activity carried out through your account, and for promptly notifying us if you suspect unauthorized access. You may not share credentials in a way that avoids plan limits or allow another person to impersonate you.

Workspace owners and administrators control membership, roles, forms, collected responses, and workspace settings. If you join an organization’s workspace, that organization may manage your access and content and may remove you from the workspace. You are responsible for obtaining all permissions and notices required to collect personal information through forms you publish using the Service.

4. Orders, Paddle, subscriptions, and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

This means that Paddle is the authorized reseller and legal seller for transactions completed through Paddle Checkout. Your purchase transaction is also governed by the Paddle Buyer Terms and the Paddle Refund Policy. Paddle handles payment processing, transaction taxes, invoices and receipts, payment-related buyer support, and approved refunds. Wobidobi remains responsible for providing and supporting the Service.

Prices, billing intervals, currencies, and applicable taxes are displayed before checkout. Unless a checkout states otherwise, paid subscriptions renew automatically for successive periods of the same length until canceled. Paddle may charge the payment method associated with the subscription on each renewal date. You may cancel through the subscription-management link in your Paddle receipt or by contacting Paddle or Wobidobi support. Cancellation prevents future renewals and normally takes effect at the end of the paid billing period; it does not, by itself, refund amounts already paid. Refund eligibility is described in our Refund Policy and is always subject to rights that cannot lawfully be excluded.

5. Acceptable Use

You must not use, or help anyone else use, the Service to:

  • violate any applicable law, regulation, court order, or third-party right;
  • collect personal information without a lawful basis, required notice, or required consent;
  • send spam, phishing messages, malware, deceptive content, or unsolicited communications;
  • harass, threaten, discriminate against, exploit, or cause harm to any person;
  • upload unlawful, infringing, defamatory, fraudulent, or malicious content;
  • collect highly sensitive information unless your plan expressly permits it and you have implemented legally required safeguards;
  • probe, scan, or test vulnerabilities, bypass access controls or usage limits, or interfere with the integrity or availability of the Service;
  • access another user’s account, data, or workspace without authorization;
  • reverse engineer, decompile, copy, scrape, or attempt to derive source code, except to the limited extent that applicable law does not permit this restriction;
  • resell, sublicense, or make the Service available to third parties as a competing service without our written permission; or
  • use automated means in a way that places an unreasonable load on the Service or circumvents documented interfaces and restrictions.

We may investigate suspected misuse and may remove content or restrict access where reasonably necessary to protect users, third parties, Wobidobi, Paddle, or the Service, or to comply with law. Our action or inaction does not make us responsible for user content.

6. Your content and respondent data

As between you and Wobidobi, you retain ownership of the forms, text, files, response data, templates, and other content that you submit to or collect through the Service (“Your Content”). You grant Wobidobi a worldwide, non-exclusive, limited license to host, copy, transmit, process, display, and otherwise use Your Content only as needed to operate, secure, maintain, and improve the Service, comply with law, and fulfill your documented instructions. This license ends when Your Content is deleted from our systems, subject to reasonable backup, security, and legal-retention periods.

You represent that you have all rights and lawful grounds needed for Your Content and for our processing of it as described in these Terms and our Privacy Policy. You are responsible for the forms you publish, the questions you ask, the people you invite, your privacy notices, your retention choices, and your responses to data-subject requests relating to information you control.

7. Intellectual Property

The Service, including its software, design, interfaces, documentation, branding, and all related intellectual property, is owned by Wobidobi or its licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service in accordance with these Terms during your subscription or permitted free access, no right, title, or interest in the Service is transferred to you.

If you voluntarily provide suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without restriction or compensation, provided that we do not publicly identify you as its source without permission.

8. Third-party services

The Service may interoperate with third-party services, identity providers, websites, or integrations. Your use of those services is governed by their own terms and privacy notices. We do not control and are not responsible for third-party services. We may suspend an integration if its provider discontinues it, changes its terms, or creates a security or legal risk.

9. Account Termination

You may stop using the Service at any time and may request account deletion by contacting us. Ending use or deleting an account does not automatically cancel an active paid subscription; you must also cancel the subscription through Paddle or contact support before the next renewal.

We may suspend or terminate access if you materially breach these Terms, fail to pay amounts due, create a security or legal risk, use the Service fraudulently, or if continued provision is prohibited by law. Where reasonably possible, we will give notice and an opportunity to remedy the issue. We may act immediately where delay could cause harm, compromise security, interfere with an investigation, or violate law. On termination, your right to use the Service ends. Provisions that by their nature should survive—including payment obligations, intellectual-property provisions, disclaimers, limitations of liability, and dispute provisions—will survive.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Wobidobi disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will meet every requirement, that all content will be preserved indefinitely, or that third-party integrations will remain available. These disclaimers do not exclude any warranty or consumer right that cannot be excluded under applicable law.

11. Limitation of Liability

To the maximum extent permitted by law, Wobidobi and its directors, employees, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, business opportunity, or data, arising out of or relating to the Service or these Terms, even if advised that such loss was possible.

To the maximum extent permitted by law, Wobidobi’s aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts paid for the Service during the 12 months immediately before the event giving rise to liability, or (b) USD 100. These exclusions and limits do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or any liability that applicable law does not permit us to exclude or limit. Some jurisdictions do not allow certain exclusions or limitations, so they may not apply to you.

12. Business-user indemnity

If you use the Service for a business or organization, you will defend and indemnify Wobidobi against third-party claims, damages, and reasonable costs arising from Your Content, your unlawful use of the Service, or your material breach of these Terms. This section does not apply to an individual acting wholly outside a trade, business, craft, or profession, and it does not require indemnification to the extent a claim was caused by Wobidobi’s breach or unlawful conduct.

13. Governing Law and Courts

These Terms and any non-contractual obligations arising from them are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-laws rules. Subject to any mandatory right you have to bring a claim elsewhere, the courts of the Republic of Kazakhstan shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. If you are a consumer, this choice of law and forum does not deprive you of mandatory protections or access to courts that cannot be waived under the law of your habitual residence. Transactions with Paddle may also be governed by the separate law and dispute provisions in the Paddle Buyer Terms.

14. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security requirements, or business practices. We will post the revised Terms and update the “Last updated” date. If a change materially affects your rights, we will provide reasonable advance notice through the Service or by email where required. Changes apply prospectively. Continuing to use the Service after the effective date of revised Terms constitutes acceptance to the extent permitted by law; if you do not agree, you must stop using the Service and cancel any subscription.

15. General provisions

These Terms, the Privacy Policy, the Refund Policy, and any plan-specific terms presented to you are the entire agreement between you and Wobidobi concerning the Service. If any provision is unenforceable, it will be modified only to the minimum extent necessary and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, reorganization, sale of assets, or by operation of law, with notice where required. Neither party is liable for delay caused by events beyond its reasonable control, except for payment obligations.
